Our funds employ a credit-oriented approach to investing in legal assets.

We combine credit structuring and legal underwriting to create pools of legal assets and lend against them in a manner consistent with how a traditional asset-based lender would lend against receivables or inventory.

Employing a credit oriented approach to capturing the upside from contingent legal assets helps to remove the traditional challenges of scalability, dependence on binary outcomes and the potential repetitional risks associated with single litigation events.

The Evolution of the Asset Class

Legal Assets investing is at an inflection point due to broadening acceptance of litigation finance by counterparties and the increased presence of institutional capital in the asset class.

In the late 1990s and early 2000s, the United Kingdom and Australia began to loosen laws around third-party financing of litigation.

In order to replicate contingency fee type arrangements in the United States, these jurisdictions permitted third-party financing of litigation fees.

This led to the creation of a venture capital like model in Europe and Australia of third-party financing. Outcomes were generally binary, dependent on the outcome of a single case, resulting in either a multiple based return (generally 3x) or a full capital loss. After the financial crisis, regulations and general attitudes toward litigation finance began to shift.

Today, large amounts of capital can be deployed to create diversified pools of legal assets that may tend to be uncorrelated to broader markets and structured to produce sustainable, credit-like returns.
